Terms of Service

1. Eligibility

You must be at least 18 years of age to use the Service. By using Riako, you represent and warrant that you meet this age requirement. We reserve the right to request proof of age and to suspend or terminate accounts that do not comply.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We are not liable for any loss arising from unauthorized access to your account.

3. The Service

Riako provides an AI-powered character chat platform that allows users to create AI characters and engage in conversations with them. The Service may also include AI-generated images and other content.

AI-generated content is fictional and may be inaccurate, unpredictable, or offensive. AI characters are not real people and do not provide factual information. You acknowledge that AI responses are generated by machine learning models and should not be relied upon for any real-world decisions.

Riako is not a substitute for professional advice. The Service is for entertainment purposes only and does not replace medical, mental health, legal, financial, or any other professional services. If you are experiencing a crisis, please contact your local emergency services.

4. User Content

"User Content" means any content you create, submit, or transmit through the Service, including characters, messages, descriptions, and uploaded images.

• You retain ownership of the User Content you create.
• By submitting User Content, you grant Riako a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, and display such content solely for the purposes of operating, improving, and providing the Service, including training and improving our AI models.
• You are solely responsible for the User Content you submit and represent that you have all necessary rights to grant the above license.

5. AI-Generated Content

"AI-Generated Content" means any text, images, or other outputs produced by the Service in response to your interactions. You may use AI-Generated Content for personal, non-commercial purposes, subject to these Terms. We do not guarantee the accuracy, completeness, or appropriateness of any AI-Generated Content.

6. Prohibited Conduct

You agree not to use the Service to:

• Generate, distribute, or facilitate child sexual abuse material (CSAM) in any form.
• Create content that sexualizes minors, real or fictional.
• Impersonate real individuals without their explicit consent.
• Generate deepfakes or non-consensual intimate imagery of real people.
• Promote, incite, or provide instructions for violence, terrorism, or self-harm.
• Harass, bully, threaten, or intimidate any person.
• Distribute malware, spam, or engage in phishing.
• Circumvent any content moderation, safety filters, or access restrictions.
• Use the Service for any illegal purpose or in violation of any applicable law.
• Use automated tools (bots, scrapers) to access the Service without our prior written consent.

We reserve the right to remove any content and suspend or terminate any account that violates these rules, at our sole discretion and without prior notice.

7. Subscriptions and Payments

Riako offers free and paid subscription plans. Paid features are billed on a recurring basis (monthly or annually) through our third-party payment processor (Stripe). By subscribing, you authorize us to charge the applicable fees to your selected payment method.

• Prices are displayed at the time of purchase and may be subject to change with reasonable notice.
• Subscriptions renew automatically unless cancelled before the end of the current billing period. You may cancel at any time through your account settings.
• Credit purchases are one-time, non-refundable transactions.
• Refunds for subscriptions may be issued at our sole discretion. Refund requests can be submitted to [email protected].

8. Intellectual Property

The Service, including its design, code, AI models, branding, and all related intellectual property, is owned by Donneko OÜ and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without prior written consent.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, Donneko OÜ and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Donneko OÜ from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.

12. Termination

We may suspend or terminate your account at any time, with or without cause, and with or without notice. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Tallinn, Estonia.
